Definitions

"Service"

Refers to AutoChangelog, the automated changelog generation platform accessible at autochangelog.com, including all features, content, and functionality.

"User," "You," "Your"

Refers to any individual or entity that accesses or uses the Service.

"We," "Us," "Our"

Refers to AutoChangelog.

"Content"

Includes but is not limited to text, code, images, changelogs, and any other material available through the Service.

Description of Service

AutoChangelog is an automated changelog generation service that:

• Connects to your GitHub repositories via OAuth authentication
• Monitors commits, pull requests, and deployments
• Generates AI-powered changelog summaries using OpenAI
• Publishes changelogs in multiple formats (web, RSS)
• Provides webhook integrations for automated changelog creation

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

Account Registration and Security

Account Requirements

To use AutoChangelog, you must:

• Have a valid GitHub account
• Be at least 13 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

Account Security

You are responsible for:

• Keeping your GitHub OAuth credentials secure
• Notifying us immediately of any unauthorized access
• Ensuring your account information remains current and accurate
• All activities that occur under your account, whether authorized or not

Important: We will never ask for your GitHub password. All authentication is handled securely through GitHub OAuth.

Subscription Plans and Billing

Available Plans

Billing Terms

• Payment Processing: All payments are processed securely through Stripe
• Billing Cycle: Subscriptions are billed monthly or annually in advance on the date you subscribe
• Automatic Renewal: Your subscription automatically renews unless you cancel before the renewal date
• Price Changes: We will notify you at least 30 days before any price increases
• Taxes: All fees are exclusive of applicable taxes, which you are responsible for paying
• Currency: All prices are in USD

Cancellation and Refunds

• Cancellation: You may cancel your subscription at any time through your account settings or the Stripe billing portal
• Grace Period: Upon cancellation, you have a 7-day grace period before repositories exceeding your new plan limits are disabled
• Refunds: Refunds are considered on a case-by-case basis. Contact us at hello@autochangelog.com to request a refund
• No Partial Refunds: We do not provide partial refunds for unused portions of a billing period
• Failed Payments: If a payment fails, we will retry up to 3 times. After 3 failed attempts, your account will be downgraded to the Free plan

Acceptable Use Policy

You agree to use AutoChangelog only for lawful purposes and in accordance with these Terms. You agree NOT to:

Prohibited Activities

• Violate Laws: Use the Service for any illegal purpose or in violation of any local, state, national, or international law
• Infringe Rights: Violate the intellectual property rights, privacy rights, or other rights of any third party
• Abuse the Service: Attempt to interfere with, disrupt, or create an undue burden on the Service or networks connected to the Service
• Unauthorized Access: Attempt to gain unauthorized access to any portion of the Service, other accounts, systems, or networks
• Malicious Code: Upload or transmit viruses, malware, or any other malicious code
• Spam or Abuse: Send spam, automated queries, or abuse the Service in any way
• Misrepresentation: Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Reverse Engineering: Reverse engineer, decompile, or attempt to extract the source code of the Service
• Excessive Use: Use the Service in a manner that exceeds reasonable request volume or constitutes excessive or abusive usage

Violation Consequences: Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

Intellectual Property Rights

Our Intellectual Property

The Service and its original content, features, functionality, design, and branding (excluding user-generated content) are owned by AutoChangelog and are protected by:

• United States and international copyright laws
• Trademark laws
• Other intellectual property rights laws

You may not copy, modify, distribute, sell, or lease any part of our Service without our explicit written permission.

Your Content

You retain all rights to your:

• Repository code and content
• Generated changelogs
• Custom configurations and settings

By using the Service, you grant us a limited license to:

• Access your repository data to generate changelogs
• Store and display your changelogs
• Make your public changelogs available via RSS feeds
• Use anonymized data for service improvement

Third-Party Services

Our Service integrates with third-party services (GitHub, OpenAI, Stripe). These services have their own terms and intellectual property rights:

• GitHub: Subject to GitHub's Terms of Service
• OpenAI: AI-generated content follows OpenAI's usage policies
• Stripe: Payment processing subject to Stripe's terms

Service Availability and Modifications

Uptime and Availability

We strive to maintain high availability and reliability, but we cannot guarantee:

• Uninterrupted or error-free service operation
• Specific uptime percentages or service level agreements (SLAs) for free accounts
• That defects will be corrected immediately
• Compatibility with all devices, browsers, or configurations

Maintenance and Updates

We reserve the right to:

• Perform scheduled maintenance that may temporarily disrupt service
• Make emergency updates or patches as needed
• Modify, suspend, or discontinue any feature with reasonable notice
• Update these Terms to reflect service changes

We will provide advance notice for planned maintenance when possible and will strive to minimize disruption.

Limitation of Liability and Disclaimers

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of AI-generated content
• Warranties that defects will be corrected

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AUTOCHANGELOG SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Actions or inactions of third-party services (GitHub, OpenAI, Stripe, etc.)
• Inaccuracies in AI-generated content

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless AutoChangelog, its operator, and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Your content or changelogs
• Any activity conducted through your account

Account Termination

Termination by You

You may terminate your account at any time by:

• Visiting your account settings and deleting your account
• Contacting us at hello@autochangelog.com

Upon termination, your personal data will be deleted within 30 days in accordance with our Privacy Policy.

Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms of Service
• Your account is used for illegal activities
• Your use of the Service creates security risks or operational issues
• You fail to pay subscription fees after repeated attempts
• We are required to do so by law

Effect of Termination

Upon termination:

• Your right to access and use the Service immediately ceases
• Public changelogs may remain accessible unless you request deletion
• We will delete your personal data in accordance with our Privacy Policy
• No refunds will be provided for any unused portion of paid subscriptions (unless required by law)

Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

Dispute Resolution

In the event of any dispute arising from these Terms or your use of the Service:

• Informal Resolution: We encourage you to contact us first at hello@autochangelog.com to resolve the dispute informally
• Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association
• Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to participate in class actions
• Jurisdiction: Any legal action must be brought within one (1) year after the claim arises

Some jurisdictions do not allow certain dispute resolution provisions. In such cases, these provisions may not apply to you.

General Terms

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AutoChangelog regarding the Service and supersede all prior agreements.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. A waiver of any breach does not constitute a waiver of any subsequent breach.

Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of government, or failure of third-party services.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Send an email notification to your registered email address
• Display a prominent notice within the Service
• Provide at least 30 days notice before the changes take effect

Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Service and may cancel your account.
